General Rules and Regulations
Policy for Connecting Driveways, Streets, Public Roads and Field Entrences onto County Roads
County Board Resolution - April 27, 1976:
A permit must be obtained from the County Engineer to connect any driveway, street, or field entrance onto a County Road or public road within an unincorporated village or addition (non-S.I.D.) outside the city limits. The permit will specify the drainage structure that is required. Any cleaning or grading of the ditch will be done by the County. All other work, including furnishing and installing the required drainage structure, shall be done by the property owner.
Definitions
- Applicant shall mean a person who makes an application for or acquires a permit.
- Approach Road shall mean a commercial entrance and exit road and may be singular or plural.
- Connection shall mean field entrance, driveway, approach road, or public road, whichever is applicable.
- Drive shall mean a private road connecting a house, garage, or other building with a road.
- Field Entrance shall mean a private road used infrequently, e.g., used for farming operations.
- Highway shall mean a road or street, including the entire area within the right-of-way which has been designated as a part of the County Highway System.
- Person shall include bodies politic and corporate, societies, communities and public generally, individuals, partnerships, joint stock companies and associations.
- Public Road shall mean a public way for the purposes of vehicular travel, including the entire area within the right-of-way. A road designated as part of the County Highway System may be called a highway, while a road in an urban area may be called a street.
- Street shall mean a public way for the purpose of vehicular travel in a city, village, or addition.
All applications for permits shall be made on the form prepared and furnished by the County Engineer. Any person desiring to construct a new driveway or approach road or any person desiring to relocate or alter an existing approach road, shall apply for a permit to do so.
Requirements
- Plans for commercial or public road(s) must include two copies of the plot plan of the proposed installation for review by the County Engineer.
- All materials and construction methods used on work within the limits of the right-of-way shall conform to the latest Nebraska Specifications for Highway Construction.
- The applicant agrees to notify the County Engineer when work covered by the permit is initiated and again when completed.
- The applicant agrees that there will be no interference with traffic, unless specifically provided for as part of the permit.
- The traveling public shall be protected in accordance with the Manual on Uniform Traffic Control Devices for Streets and Highways.
- The applicant agrees that no portion of the right-of-way will be used for parking, advertising signs or any other commercial activity.
- Any sod, shrubs, or trees destroyed by this work shall be replaced or compensated for as directed by the County Engineer.
- The applicant, his successors, or assigns, shall assume all risk and liability for accidents and damages that may accrue to persons or property on account of his work.
- All drainage resulting from the building of an approach road shall be adequately handled to the satisfaction of the County Engineer.
- On non-curbed county roads, no curbing of an approach road shall be permitted between the ditch line and the edge of the road or eight (8) feet, whichever is greater.
- Mailboxes shall be located outside the shoulder line on roadways without curbs so that the roadside face of the mailbox does not extend beyond the shoulder line of the highway. Mailboxes shall be located back of the curb on roadways with curbs so that the roadside face of the mailbox does not extend beyond the back of the curb line of the highway. Mailboxes located within the minimum lateral obstacle clearance zone, must be mounted upon a breakaway post conforming to County standards.
